AFFIDAVIT OF FANNY BUTLER
September 5, 1855
State of Tennessee S.S }
Jackson County }
On this 5th day of September
A D Eighteen hundred and fifty personally appeared
before me an acting Justice of the peace for said
County Fanny Butler as widow out of Jackson County
in the State of Tennessee aged 73 years
who being duly sworn according to law declares that
she is the widow of James Butler deceased who was a
private in the company commanded by Captain James
Bennet in the 4th Regiment of Tennessee Militia
commanded by Colonel Steele in the War with Great
Britain declared by the United States on the 18th June
1812 that her said husband was drafted in Jack
son County Tenn. on or about the ___ day January 1814
for the term of three months and continued in actual
service in said War for the term of three months and
was honorably discharged at _____ on the ___ day of
April 1844 and that he lost his certificate of discharge
she supposes.
She further states that she was married to the said
James Butler dec.' in Buncombe County North Carolina
on or about the year 1793 by one ______ Newport a
regular Minister of the Gospel and that her name be
fore said marriage was Fanny Usry that her said
husband died in Jackson County Tenn on or about
the ___ day of ___ 1840 and that she is still a widow
She makes this declaration for the purpose of
obtaining the bounty land to which she may be
entitled under the act passed 28 Sept. 1850

ty Amos Kirkpatrick & William Hawkins who are
persons of good respectability who being first duly
sworn according to law state that they have
been acquainted with the within named James
Butler dec' and the within named Fanny Butler
for many years and that they lived together as
husband and wife and were always respected by all
who knew them as such witnesses state that
the written named James Butler died in Jackson
County Tenn about the time set forth in the
written declaration and that the said Fanny
Butler is still a widow

William Butler & Bailie Butler
me an acting Justice of the Peace for said County ^ and
makes oath in due form of law that the within
named James Butler is the same identical man
who served in Capt James Bennet company in the
4th Rgt of Tennessee Militia commanded by Col Steel
in the War with Great Britain about the time for the
term set forth in the within declaration.

a resident of Jackson County Tenn
^who being sworn according to law declares that he is the identi
-cal William Butler who was a private in the compa
-ny commanded by Captain Bailie Butler in the 1st Regiment
of Tennessee Volunteers commanded by Colonel I. K. Winn
in the War with Great Britain declared by the United States on
the 18 day of June 1812. that he Volunteered on Jackson City Ten
on or about the ____ day of September 1813 for the term of three months
and continued in actual service in said war for the term of two
months and was honorably discharged at Fort Strather
on or about the ___ day of November 1813 in consequence of wounds
received in the Battle at Talledega, all of which will be found by reference to
the muster rolls of said Company and also by reference to the Pension Rolls __(?)
He makes this declaration for the purpose of obtaining the
bounty Land to which he may be entitled under the "act grant
-ing bounty Lands to certain officers and soldiers who have
been engaged in the military service of the United States"

Sworn to and subscribed before me the day of year above written
and I hereby certify that I believe the said Wm. Butler
to be the same identical man who thus served and that
he is of the age above started

tical same William Butler whose name is now en
rolled in the Pension Office of the United States as a
Pensioner under the act of Congress paper 24th April 1816

Dear Sir
The evidence I send
for the purpose of obtaining Bounty Land for Fanny
Butler is the best that can be prepared If this should
fail bring satisfactory you will please inform
me what evidence will suffice
It is out of her power to prove her marriage for]
the reason that the marriage took place in N. C.
about Sixty years ago, consequently time has
taken away
the eye witnesses, and in all proabaly the record
cannot be had of her marriage.

of the peace in and for said County Edward Kirkpatrick
Bailey Butler and _____ ______ ____resident citizens
of said county and State a___said and being duly sworn
according to law desires and says they were personally
acquainted with James Butler and Fanny Butler in the
State f Tennessee and the said James Butler and
Fanny Butler lived together as man and wife for the
space of forty years or upwards and recognized as
such in the community in which they lived
These affidavits further states that the said James
Butler is dead and said Fanny Butler was a widow at
the time she made her application for Bounty Land
under the act of 8 of March 1855 and she is now a
widow
